If your income is below the median income in Indiana for a household of your size, you may be eligible for Chapter 7 bankruptcy. If your income exceeds the median, you most likely will not be eligible for Chapter 7, but you may be able to file Chapter 13 instead. An attorney can help you decide which chapter is right for you.

Under Chapter 7 bankruptcy, many of your debts will be discharged. Unsecured debts such as credit card debt and medical bills are typically discharged. You may also permanently discharge secured debts; however, you must return the property to the creditor in these situations. If you can reaffirm these secured loans and keep making the payments, you can keep the property.

If you want to keep secured property such as your home or vehicle, you must continue to make the payments. Chapter 13 bankruptcy generally makes this easier because your debts will be restructured into a repayment plan of three to five years. Under this plan, the monthly payments on your loans will be lowered.

Our knowledgeable attorney will discuss the benefits of the automatic stay and how it protects you from creditor harassment, wage garnishment, vehicle repossession and mortgage foreclosure. All chapters of bankruptcy provide the automatic stay. Once you file bankruptcy, the automatic stay goes into effect and prevents creditors from contacting you directly.
